À l'assemblée annuelle du American Intellectual Property Law Association (AIPLA), il y a deux semaines, LE sujet de l'heure était bien entendu les rejets de revendications sous l'article 35 USC 101.  Dans les ascenseurs, au pub, au gym, au gala, dans les dégustations de scotch, partout!  Le réseautage n'a jamais été aussi facile par contre : « so, how about that 101? »!

En gros, plusieurs demandes de brevet rédigées d'une manière anciennement acceptée sont bloquées au USPTO, parce que les revendications portent soi-disant sur une idée abstraite.  C'est le sujet de l'heure parce que lignes directrices envoyées aux examinateurs du USPTO sont mélangeantes, parce que les agents de brevets sont mélangés, et parce que les avis sur comment sortir de ce piège sont... mélangés.

L'IPIC organise sous le chapitre montréalais des « Informals » une formation sur la manière de rédiger des revendications et des demandes de brevet pour respecter les lignes directrices du USPTO, et démêler tout ça.  Les détails sont ci-dessous.  Je recommande surtout aux membres de la communauté PI qui travaillent sur les revendications de participer – le sujet sera peut-être un peu aride pour les observateurs qui connaissent peu les fameuses «claims».

C'est une formule « midi-conférence », et l'horaire est respecté.

Richard Bauer, from Katten Law, will be presenting on drafting techniques to avoid 101 rejections as currently applied by the USPTO.

Richard P. Bauer is co-head of Katten's Patents practice and concentrates on patent prosecution, validity and infringement opinions, intellectual property licensing and client counseling. He devotes a significant portion of his practice to advising clients on monetizing patent portfolios, including licensing, due diligence, joint ventures, and mergers and acquisitions. In addition, he has substantial experience in US Patent and Trademark Office (PTO) ex parte and inter partes reexaminations, reissues, interferences and various petitions, and is currently involved in several inter partes review proceedings.
