To date, the Supreme Court of Canada has not recognized a constitutionally protected right to strike a right. It has, arguably, moved in that direction. On May 16, 2014, the Supreme Court of Canada heard argument and reserved judgment on an appeal from Government of Saskatchewan v. Saskatchewan Federation of Labour, 2013 SKCA 43. The Court's decision on the appeal should clarify its views on whether a right to strike is protected under the Charter of Rights and Freedoms.  At issue is the constitutionality of Saskatchewan legislation that restricted the right of essential services employees to strike, made union certification somewhat more difficult and liberalized the scope of permissible communications between employers and their employees.
