Michael Osborne to be a panelist on the proposed cross-border price discrimination legislation at the Canadian Bar Association's National Competition Law Section's Fall Conference on September 18-19

Closing the Price Gap – The Bureau's (Possible) New Role as Price Regulator

In the Spring, the Government announced that it plans to introduce legislation to address "price discrimination that is not justified by higher operating costs in Canada." The legislation would empower the Commissioner of Competition to enforce the new framework. However, price gap legislation would pose significant challenges for the Competition Bureau. For example, how would the Bureau define unjustified price differences? How would it adjust for fluctuations in the exchange rate on a daily basis? How would it obtain the resources to investigate and enforce cross-border price differences? And how would businesses ensure compliance with the new framework? Join the panel for a frank discussion about this controversial legislative proposal.
