The Bill number 52/2013, that aims to establish applicable rules to regulatory agencies by creating a unified regulation system to be observed by all the federal regulatory agencies, is now being processed in the Brazilian Federal Senate.

Currently, there are several specific laws regulating each regulatory agency's legal regimes, and oftentimes demonstrating incompatibility among them.

The main topics covered by the bill are: detail of the linking between agencies and ministries and the terms of their administrative autonomy; standardization of the decision-making system through the procedures of consultation and public hearings; setting more clear and strict rules of accountability, including the preparation of annual reports to be published on the internet and in major newspapers; external control through the publication of the "Strategic Plan" , the "Annual Management Plan" and the "Regulatory Agenda"; creation of Ombudsman to act without hierarchical subordination; establishment of rules for institutional cooperation between federal regulatory agencies and other agencies and governmental entities, such as the Administrative Council for Economic Defense (CADE), the consumer defense agencies, the environmental agencies, the state and municipal regulatory agencies; amendment of the mandates of the agencies leaders for five years, with the prohibition of reelection.

The Bill was initially sent to the Constitution, Justice and Citizenship Committee (CCJ), which gave assent to the bill based on the substitute presented to the Environment, Consumer Protection, Monitoring and Control Committee (CMA).

Subsequently, the Senate's Chairmanship determined that the Bill should be examined by the National Development Special Committee (CEDN), which approved the new substitute bill.

Currently, the project is awaiting the additional voting shift, being opened a deadline for the offering of amendments to the substitute bill.

Nowadays, there are ten federal regulatory agencies in Brazil: National Electrical Power Agency (ANEEL); National Petroleum Agency (ANP); National Telecommunications Agency (ANATEL); National Sanitary Surveillance Agency (ANVISA); National Supplementary Health Agency (ANS); National Water Agency (ANA); National Maritime Transportation Agency (ANTAQ); National Land Transportation Agency (ANTT); National Film Agency (ANCINE); National Civil Aviation Agency (ANAC).
