The Board Decision No. 69/2016/P, issued by CETESB - São Paulo State Environmental Protection Agency, which provides on the presentation of studies, technical reports, environmental assessments and other similar documents containing technical information, was published today (April 14, 2016) on the Official Gazette of the State of São Paulo.
The Decision sets forth that the mentioned technical documents shall contain (i) a specific chapter dedicated to the conclusions of the issue being addressed, (ii) a table comparing the obtained values and official thresholds and (iii) the Statement of Responsibility signed by the Legal Representative of the company and by the Technical Representative to confirm the veracity of the presented information and the full compliance with the requirements imposed by CETESB.
The template of the Statement of Responsibility highlights that the presentation of false or misleading information to the environmental authority may lead to crime against the environmental Public Administration.
The Board Decision comes into force within 30 days from its publication.
