In May, we circulated an update about New York State and New York City's new anti-harassment laws and how to comply with them.

In a continued effort to highlight the need for employers to prevent sexual harassment in the workplace, as of last month, NY State has added an employment practices form to the film tax credit application. The New York State Film Production Tax Credit is a program that provides qualifying film and television productions with a 30% credit for qualified production expenditures.

Now, when companies fill out the form to obtain the New York State Film Production Tax Credit, they will also be asked to include the Employment Practices Form as part of their initial application. The form contains several questions with respect to whether the applicant maintains an anti-sexual harassment Code of Conduct, and if not, whether the applicant would be willing to adopt one within the next 30 days.
